The first question that springs to mind while planning to travel overseas - What is Apostille? In simple terms, it is the legitimate process required to be fulfilled for the authentication of your documents. It is a type of attestation that allows certificates to be legalized in an appropriate way. In legal terms, an apostille is a formality to prove the authenticity and legitimacy of documents. It serves as a certification that the document can be relied on to be authentic and credible.

In a country as India, having an Aadhar card or other documents like your Birth Certificate or marriage certificate is proof that you are a legal citizen of a country. But these documents are not valid when you travel overseas. To be treated as credible and authentic, your documents need to get apostilled.


WHEN DO YOUR DOCUMENTS GET APOSTILLED?

The documents get apostilled once you have received an apostille stamp from the Ministry Of External Affairs. The Ministry of External Affairs is the sole authority in India which issues the apostille stamp which includes all the necessary details of a person and the authority which issues that. An Apostille stamp is a square-shaped stamp that is issued at the back of the document. This stamp is computer generated and has a Unique Identification Number. This identification number helps to verify the legal status of your documents in a foreign country.


WHEN NEEDED?

An apostille is needed when you are planning to travel to any country which is a member of the Hague Convention. There can be many documents that require an apostille stamp. For instance- When you travel abroad for study purposes, you need to get your educational documents apostilled to provide them a credible status in another country. The apostille stamp will let the member country of the Hague convention verify your qualification status. Documents that are apostille are verified and are legal to use in the country to which they are apostille.


THE HAGUE CONVENTION

Whenever traveling to a foreign country, one needs various documents to use for various reasons. In general, a foreign country can only use or accept a document issued by another country if it has been authenticated. The whole Authentication process was time-consuming and costly where the authorities of the country where the document was issued along with the Embassy in that country verify to the authenticity of the document. Therefore in 1961, a joint initiative was taken by many countries to simplify this process of 'Legalization'. The conference referred to as the Hague Convention, adopted a document called Apostille, which once issued by one country should be valid in all other member countries.


CATEGORY OF DOCUMENTS WHICH NEED AN APOSTILLE STAMP- :

1) PERSONAL- Personal documents are those which contain all the necessary information related to a person. These include your:-

2) HOME DEPARTMENT ATTESTATION- At the state level, Home Department is the organization that is responsible for the certification of your personal documents. Legalization of documents from the same state government falls under its purview.

3) HRD ATTESTATION- All your educational documents are certified solely by the Human Resource Department.

4) SDM ATTESTATION- SDM attestation is an alternative to the state attestation which is done in case HRD or Home Department Attestation is not preferable.

5) CHAMBER OF COMMERCE ATTESTATION- This kind of attestation is solely responsible for certifying the commercial documents.

6) MEA ATTESTATION- This is the final step of legalization where the MEA issues an apostille stamp and provides credibility to all documents.
